A division bench of the Madras High Court dismissed the Union Government’s petitions against Sun Group companies’ participation in the phase III FM auctions.

Justices Satish Agnihotri and KK Sasidharan upheld an earlier ruling of a single bench order allowing Sun TV Group companies — Sun TV Network, South Asia FM and Kal Radio — to participate in the FM auctions conducted by the Union Ministry of Information and Broadcasting.

According to counsel for the Sun Group J Ravindran, the Union Government had appealed against the order. But the Division Bench upheld the Single Judge order that the group companies cannot be denied permission to participate in the FM auction on the grounds that criminal cases were pending against its promoter Kalanithi Maran.In a separate order, the Division Bench also dismissed the Union Government’s appeal relating to Kal Cables’ security clearance.
