Likely to send notice to the debt-laden airline on payment of provident fund and gratuity

The Regional Labour Commissioner’s office here is likely to send a notice to Jet Airways for not submitting the details of the list of employees, and their provident fund and gratuity due which were to be submitted by May 2.

This follows a plea by the All India Jet Airways Officer’s and Staff Association to the Regional Labour Commissioner over non-payment of salary, provident fund and gratuity under Section 33C of the Industrial Dispute Act. After a hearing, the Labour Commissioner asked the management of Jet Airways to file documents relevant to the payment. However, as of May 3, the submission was not done.

According to an official, “A complaint was filed by the union, after the first notice was sent to the CEO, his representative had come to the Regional Labour Commissioner’s office. They were told to submit the documents with a list of employees, and their provident fund and gratuity details. The company had asked for time till May 2. So far, the documents have not been submitted, if we do not receive them by Monday, we may send them a formal notice requesting the same.”

As per the procedure, after a complaint is filed with the Regional Labour Commissioner for non-payment of dues, a representative of the company is called to discuss the matter along with the complainant. Once the details are submitted by the company, a hearing is formally set up and a claim case is registered.

The airline has approximately 22,000 employees. Various departmental employees of the debt-burdened airline have not been paid for the past two to four months. Several employees have quit the company to join other airlines and companies, however, their statutory dues such as provident fund and gratuity are yet to be paid.

An email query sent to Jet Airways remained unanswered till the time of going to press.
