The Bombay High Court has asked the Directorate-General of Foreign Trade (DGFT) to consider the application of Mr Anil Somani, a ginner from Maharashtra, for quota to export cotton.

Mr Somani had filed a petition on June 26 challenging the procedure of quota allocation adopted by DGFT.

Mr Somani contended that the DGFT had erred by stipulating that additional export quota would be given to only those who had export cotton during 2008-09 and 2009-10 season (October-September). He contended that those who shipped cotton this season should also be considered and, therefore, the DGFT should reconsider the eligibility clause. He also sought opening of exports for ginners too.

Based on higher cotton production this season, the Government had allowed export of 10 lakh bales over and above the 55 lakh bales that was already exported. Registration for the additional quota ended on June 25.

Though the Court had directed DGFT to consider the application, it is the prerogative of DGFT to clear Mr Somani's application, traders said.

Mr Sanjay K. Jain, Joint Managing Director, TT Ltd, said the development may lead to more exporters filing individual application in the Court and delay the whole process of considering export applications.
