The consortiums of banks’ led by State Bank of India (SBI) have sought attachment of Vijay Mallya’s aircraft sale proceeds.

At the Bengaluru bench of Debt Recovery Tribunal (DRT), on Wednesday, the consortium of banks’ filed an application for the deposit of sale proceeds of Vijay Mallya’s aircraft by the Service Tax Department in the court.

The Counsel for Consortiums of banks’ told court, “I am filing an application for the attachment of sale proceeds which the Service Tax Department will be receiving on sale of aircraft through auctions.”

The Service Tax Department has scheduled auction of aircraft for May 12-13.

The consortium of banks’ also informed the DRT and filed a memo stating that Diageo payments to Vijaya Mallya have not been deposited in the court.

Filing objections to counter claims made by United Breweries Holdings Ltd (UBHL), the counsel for Consortiums of banks’ said: “Two more memos are filed – one seeking extension of interim order and the other where in Diageo Plc be directed on garnishee application for depositing the $70-million.”

To this, counsel for Diageo said: “Objections have been filed. My contention is that this amount is not due from me as on date. So I am therefore unable to honour it.”

In his argument, the Counsel for UBHL said: “I will be filing objections. Auction of aircraft is being held next month. So please post it for last week of this month.”

The consortiums of banks’ have also filed objections before the DRT with regard to counter claims made by UBHL.

After hearing submissions, CR Benakanahalli, Presiding Officer of the DRT Bengaluru Bench posted the matter for next hearing on April 21.
