The toll road operator of Delhi-Gurgaon highway got some respite on Friday with the Delhi High Court putting a stay on National Highway Authority India’s (NHAI) termination notice to the developer.
“The effect of show cause notice has been stayed till pronouncement of order in present case,” said a source. DSC Ltd, the toll road operator, had moved Court against the termination notice.
The stay comes a day before NHAI’s 15-day termination notice would have come into effect.
On March 8, NHAI had issued a 15-day show cause termination notice to the developer of Delhi-Gurgaon project.
The next hearing is slated for April 3.
NHAI had issued the termination notice as there was a lack of clarity on who would take the responsibility to improve services of the project. This was committed by NHAI and developer in an out-of-court settlement earlier.
IDFC, which was the lead lender for the project and had even got an NHAI Board approval to take over a majority stake in project in early 2013, later started having second thoughts. IDFC had also moved Delhi High Court seeking to replace the developer.
