Responding to the Gujarat High Court’s Thursday order that no creeks near the Mundra Special Economic Zone (SEZ) shall be filled till August 7, 2008, its promoters, the Adani Group, has clarified that the court has not stayed construction work.

Reacting to the “inaccurate reports circulated by vested interests” that the High Court has granted stay against construction activity at Mundra, the Adanis said in a statement that the Supreme Court had, on July 9, dismissed a public interest litigation (PIL) as withdrawn.

“No such stay was granted by the Supreme Court.” It said certain people “claiming to be fishermen” had moved the PIL in the SC and obtained a stay on July 1. When the company presented the facts to the apex court, the petitioners sought the court’s permission to withdraw the petition and a stay until they moved the Gujarat High Court.

On July 15, the petitioners moved the High Court asking for a status quo to be maintained for construction activity in the entire Mundra SEZ. After the Thursday’s hearing, the High Court ordered notices to be issued and posted the matter for hearing on August 7, while directing that a reply be filed on or before August 4.

The Adanis have also assured that the company has no intention of filling any creek. Acting Chief Justice Mr M.S. Shah and Mr Justice D.H. Waghela of Gujarat High Court had issued notices on the petition filed by Mr Jat Imran Salim and six others to the Union of India and others, including the Adanis.

The notices were returnable on August 7 while the court directed that the affidavits be filed by August four. It also directed that “There shall not be any filling up of the creeks till August 7.”
