Corporate Disputes CESC challenges move of power regulatory body Our Legal Correspondent
KOLKATA, Feb. 8 CESC Ltd has filed an appeal before Mr Justice Samaresh Banerjea and Mr Justice Indira Banerjee of the Calcutta High Court, challenging the action of the West Bengal Electricity Regulatory Commission (ERC), a body set up by the West Bengal Government for fixing electricity tariff. CESC alleged that the ERC had asked for a proposal for tariff fixation for the year 2002-03 from the five power generating units in the State. The earlier tariff fixation was a matter sub judice before this court and without settling the previous rates, the new approach was not legal, CESC stated. There are five producing units Disergarh Electric Supply Co Ltd, Durgapur Project Ltd, West Bengal State Electricity Board, CESC Ltd and Vidyut Unnayan Nigam Ltd. Of these, only CESC Ltd and Durgapur Project Ltd have preferred appeals for the fixation of tariff of electricity in the previous years. The matter is likely to come up before the court on February 12.
