Broadcasters' plea against CAS pricing rejected

The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has rejected Set Discovery and ESPN Star Sports' appeal against regulator Telecom Regulatory Authority of India tariff order of Rs 5 per channel for conditional access system (CAS) areas.
The court is reported to have said that TRAI was justified in its efforts to regulate the implementation of CAS and had acted fairly by balancing competing interests. The Tribunal also directed the two broadcasters to pay Rs 50,000 each to TRAI as litigation cost.
In August 2006, TRAI had issued notification for implementation of CAS and fixed ceiling price of Rs 5 per channel for CAS-notified areas.
The order had been challenged by the broadcasters who had argued that the Rs 5 tariff was unviable.
The two broadcasters had also challenged the authority's revenue sharing model, fixed at 45 per cent for the broadcaster, with the rest being shared between the multi-system operators and the local cable operator.
