Corporate Disputes
Our Bureau Hyderabad, June 3 Upaid Systems today said that they have broadened the scope of the court litigation which they have set up against IT services provider Satyam Computer, by incorporating recent revelations in the UK court. Upaid and Satyam are locked in a litigation over the former claim for loss due to alleged fraud by the latter for providing software development. In a statement from London, Upaid Systems said that the recent revelations during hearings in the UK appeal court would now lead to include “misrepresentation and failure” to provide good title during their patent process. Reacting to Upaid statement, the Satyam Global Head Marketing and Communications, Mr. Hari Thalapalli, said here: “It is Satyam’s policy to refrain from commenting on any ongoing litigation involving the company or comment on speculation by the interested parties.” Upaid Systems spokesperson, Ms. Joanne Hunter, stated “contrary to Satyam’s recent public comments on their damages exposure, there is no limitation on damages in the case, neither for frauds nor breaches of contracts. In the new filings (to be taken up in a Texas court) Upaid has indicated that our damages are likely to exceed $1 billion.” Mr Hari said “we have clarified our points in this matter in our earlier statement. We believe there is no material development that merits a consideration since then.” Upaid Systems and Satyam are engaged in legal battle over the software development work the latter handled for the former and issues related to patent filings. The matter was litigated in the UK initially over the jurisdiction of the case. However, with the UK court ruling that the matter be taken up in the US court, this will now be heard in the Texas (US) court in 2009.
