Worried at 90

T. Banusekar

I AM 90 years old and have been filing my returns promptly every year. There are refunds due for some of the years. Can I nominate any of my family members to receive the refunds if these are not received during my lifetime.

You cannot nominate any person to claim the refunds due to you. However, Section 238(2) specifically provides that where through death, incapacity, insolvency, liquidation or any other cause a person is unable to claim or receive any refund due to him, his legal representative, trustee, guardian or receiver, as the case may be, shall be entitled to claim or receive such refund for the benefit of such person.

In the unfortunate event of your dying before the grant of refund, your legal representatives can claim the refund on behalf of your estate.
