Kolkata April 20 The Calcutta High Court on Friday restrained two city-based software houses from using in their business the brand name of Infosys or Infy, as these are the original trademark of Infosys Technologies Ltd, headed by Mr Narayana Murthy. Infosys moved two separate suits against Sumit and Vedant Infosys, two city-based firms engaged in hardware, software and computer peripherals business. Justice Indira Banerjee passed the order. In the suit, Infosys alleged that the two Kolkata-based companies were using illegally the expression `Infosys' as a prominent mark of their business and using the trademark, which is already registered by Infosys Technologies. It was further alleged that these two companies have infringed the registered trademark of Infosys and passing off their goods and services, which are wholly owned by Infosys alone since 1991. As the two companies did not appear, even after serving of notice, the court after hearing the submission of Infosys, passed an ex parte interim order restraining Sumit and Vedant from infringing the registered trademark of Infosys. The court further restrained the two firms from passing of their goods and services and in any way using the business name or trademark `Infosys' or `Infy' until further orders. The court fixed May 2, 2007 as the date for further hearing.
